TAROCASH BIRTHDAY MAIL-OUT TERMS AND CONDITIONS


1.    Information on Vouchers and how to participate form part of these terms and conditions. Participation in the offer is deemed acceptance of these terms and conditions.

2.    To  have a valid claim:

2.1    new subscribers must(a) visit www.tarocash.com.au; (b) follow the prompts to the promotional page and complete the promotional form in full, including the participants date of birth in the format specified by the Promoter and a valid mailing address; and (c) successfully submit the completed promotional form;

2.2    existing subscribers, being those who have already completed, and successfully submitted, the “Win $100 Gift Voucher” form on the website at www.tarocash.com.au, must supply the Promoter with their date of birth in the format specified by the Promoter, if they have not already done so.

2.3   any subscriber who opts to unsubscribe is deemed to be no longer a valid subscriber and is therefore not eligible to receive a voucher.

3.     All subscribers who provide their birth date in the format requested will be mailed a voucher entitling the bearer to $50 off any Tarocash merchandise, including sale merchandise, in any store within their country of residence, on or near the date of their next birthday (“Voucher”). Only one Voucher will be provided to each eligible participant for each birthday occurring during the running of this promotion.

3.1 A participant is identified by their email address. If a subscriber reenters their name, mailing address, phone/mobile numbers or date of birth details under the same email address, the most recent details will override any older ones. If multiple people enter using the same email address, only the most recent entry will be registered as a valid subscriber.

3.2   Birthday vouchers are processed on the 15th of the month prior to the month in which the birthdays fall, and are mailed monthly. If a subscriber enters their details between the 16th of the month before their birthday and the 15th day of the month their birthday falls in, they will be sent a voucher the following month. If a subscriber enters their details after the 15th day of their birthday month, they will be sent a voucher 2 months after their birthday month.  If a subscriber enters their details at any other time, they will be sent a voucher during the month their next birthday falls. Vouchers will not be sent retrospectively.

4.    Voucher must be redeemed prior to the expiry date shown on the Voucher.

5.    Promotion commences  1 July, 2009. Only open to residents of Australia and New Zealand who are subscribers to Tarocash, as identified at 2 of these Terms and Conditions. Employees of the Promoter and its agents are not eligible to redeem a Voucher.

6.    Voucher is valid for one purchase transaction only, although the purchase transaction may include multiple items. One Voucher per transaction. Subscriber will be asked to forfeit Voucher at end of the purchase transaction.

7.    No minimum spend required, but no credit will be provided if any unused balance remains at the end of the purchase transaction. Voucher is not transferable or redeemable for cash. Vouchers cannot be pooled together and are not redeemable on lay-bys or in conjunction with any other offer.

8.    If item(s) purchased using the voucher are returned and the subscriber requests, and is entitled to, a refund ;

8.1    the Promoter is only liable to refund the net  cost paid by the subscriber for the item(s), that is, the price for which the item(s) was/were sold to the subscriber, less the amount of the voucher used to purchase it/them; and

8.2    the voucher may not be used again.
 
8.3   Subject to the above, any  return of item(s) purchased using the voucher is subject to the normal terms and conditions of the Promoter, including its Returns Policy.

9.    Any ancillary costs associated with redeeming the Voucher are not included and will not be compensated.

10.    Only one birth date will be accepted per subscriber.

11.    Incomplete, indecipherable, incorrect or undeliverable claims will be deemed invalid.


12.    Voucher will be mailed at the end of the month proceeding, or beginning of the actual month the subscribers birthday falls. All Vouchers will be mailed from Sydney via regular Australian and/or New Zealand post to the mailing address provided by the subscriber.

13.    Voucher will expire at the end of the month following the month the subscriber’s birthday falls in. If there is an inconsistency between this clause and the expiry date on the Voucher, the expiry date on the Voucher prevails.

14.    Except for any liability that cannot be excluded by law, the Promoter (including its employees, officers, contractors and agents) will not be held liable (including in negligence) for any personal injury, loss or damage (including loss of opportunity) arising as a result of this promotion, including (but not limited to):

• any technical difficulties or equipment malfunction, whether or not under the Promoter’s control;
• any theft, unauthorised access or third party interference; and/or
• any entry or Voucher that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter.
   

15.     The Promoter will not be held liable for any lost, misdirected, undeliverable or mistimed mail caused by:

• errors (accidental or otherwise), technical difficulties, equipment malfunction, or negligence of any third party hired by the Promoter to manage subscriber database, or to print and mail the vouchers.
• birthday or address errors provided by the subscriber,
• disruption, error, theft or mishap within the Australian or New Zealand postal system.
   

16.    The Promoter will use all reasonable means to contact any subscribers whose Vouchers have been returned due to undeliverability. However, the Promoter reserves the right to destroy any returned Vouchers where subscriber cannot be contacted or is unable/unwilling to provide a valid mailing address. Such subscribers will not be compensated.

17.    Any cost associated with accessing the promotional website or providing personal details (including birth date and address) is the subscriber’s sole responsibility and is dependent on the Internet service provider used.

18.    The Promoter reserves the right to verify the validity of claims and participants (including a subscriber’s identity, age and address) and to disqualify any subscriber who submits a claim that is not in accordance with these terms and conditions or who tampers with the entry process or if there are reasonable concerns the subscriber is attempting to mislead or defraud. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

19.    The Promoter reserves the right to alter the value or timing of Vouchers issued over time. Any such change will be reflected in promotional information provided on this website. Any Vouchers provided to subscribers prior to this change will retain the value & expiry date printed on the Voucher.

20.    The Promoter reserves the right to cease supply of Vouchers at any time. Promotional material advertising birthday vouchers will be removed from this website and any other location controlled by the Promoter at that time.

21.    The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and for any purpose required by any regulatory authority. Entry is conditional on providing this information. Unless otherwise advised, the Promoter may also use the information for promotional, marketing and publicity purposes. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
